Legal positivism maintains a distinction between law as it is and law as it ought to be. In other words, for positivists, a law can be legally valid even if it is immoral. H. L. A. Hart hoped to defend legal positivism against natural law. This paper analyses Hart’s criticism of Gustav Radbruch, a natural lawyer, before suggesting that Hart’s account of legal positivism gives rise to a logical problem. In his presidential address on “Symbols, Signs, and Signals,” given before the Association for Symbolic Logic, December 28, 1938, Professor C. J. Ducasse made and important distinction between what he there called the indicative and the quiddative symbol. He remarked in passing that he thought it possible to show that: 1) “The same entity may function both as indicative and as quiddative symbol: or one part of a complex symbol may be quiddative and another indicative”; and 2) “the difference between (...) the two roles is irreducible: the indicative is not a species of the quiddative nor vice versa.” An indicative symbol is defined as “one of which the distinctive property is to orient our attention to some place in an order system …”; and a quiddative symbol as “one of which the distinctive property is to make us conceive a certain kind of thing—a certain ‘what'—no matter where in any order system it may or may not be existing.”. In this paper I argue for a computational theory of thinking that does not eliminate the mind. In doing so, I will defend computationalism against the arguments of John Searle and James Fetzer, and briefly respond to other common criticisms.

The present article is the first in a series of three that outlines the historical and conceptual background of B.F. Skinner’s radical behaviorism. The series seeks to identify milestones in the development of Skinner’s position, as well as assess the impact of particular factors and events on Skinner himself. Of special interest in this article are the biographical details of Skinner’s life between June, 1926, when he received his undergraduate degree, and September, 1928, when he entered graduate school. The article (...) also examines the intellectual climate at the start of the second quarter of the twentieth century that led Skinner to become interested in the empirical study of behavior. Overall, Skinner’s views during this period were significantly influenced by such literary figures in the modernist tradition as H.G. Wells and Sinclair Lewis; and such scientific/philosophical figures as Francis Bacon, Jacques Loeb, Ivan Pavlov, Bertrand Russell, and John B. Watson. (shrink)

This study argues that the early philosophy of Semyon Liudvigovich Frank (1877–1950) exhibits significant intellectual correlations with nineteenth century German Idealist philosophy. The idealists in question are Immanuel Hermann Fichte (1796–1879), G.W.F. Hegel (1770–1831) and F.W.J. Schelling (1775–1854). It will be suggested that the critical tension of Frank’s early philosophy is precisely a tension between his Hegelian and Schellingian tendencies. The paper will first introduce Frank’s theory of a “personal absolute”, exploring its surprising parallels with the religious philosophy of I. (...) H. Fichte. The analysis then addresses the self-dispersal of Hegel’s absolute, before finally turning to Schelling’s immediate intuition of subject-object identity. (shrink)

Sense of agency refers to the sense of initiating and controlling actions in order to influence events in the outside world. Recently, a distinction between implicit and explicit aspects of sense of agency has been proposed, analogous to distinctions found in other areas of cognition, notably learning. However, there is yet no strong evidence supporting separable implicit and explicit components of sense of agency. The so-called ‘Perruchet paradigm’ offers one of the few convincing demonstrations of separable implicit and explicit learning (...) systems. We adopted this approach to evaluate the implicit–explicit distinction in the context of a simple task in which outcomes were probabilistically caused by actions. In line with our initial predictions, we found evidence of a dissociation. We discuss the implications of this result for theories of sense of agency. (shrink)

PITTION MY PURPOSE IN THIS PAPER is to discuss an aspect of Hume's reading of Pierre Bayle, the French "Philosopher of Rotterdam. ''1 I am not concerned here with the identification of Hume's direct borrowings from Bayle in the Treatise, nor with the much wider problem of a probable influence of Bayle on (...) Hume. It is indeed possible to identify in the Treatise a number of specific points taken from Bayle. Kemp Smith listed four at least: the account of skepticism, the discussion of Spinoza, the discussion of animal intelligence, and the criticism of the argument from design. 2 All of these come from Bayle's Dictionnaire. External evidence confirms that in 1732 Hume had a work of Bayle, presumably a copy of the Dictionnaire. Other borrowings from Bayle have been identified in the Treatise and in Hume's other works. This is no surprise, for in the eighteenth century Bayle's Dictionnaire was used as it was intended in the first instance, that is, as a reference work. In detailing the borrowings from Bayle, Kemp Smith also touched upon the broader question of influence when he stated that Hume's Pyrrhonism, particularly in relation to his treatment of religion, may also come from Bayle. Many recent scholars have followed suit. A problem of influence however is always a difficult one, and particularly so in this case. There was, as R. H. Popkin has pointed out, a broad awareness of continental skepticism among British philosophers of the eighteenth century. 3 However, apropos Berkeley, A. A. Luce has remarked that the trouble with eighteenth-century continental skepticism was that it had various objectives and took various forms. 4 This is true of Bayle himself. Within skepticism Bayle's position was known for its extremism, and it was this extremism that brought him notoriety. During the eighteenth century Bayle was the philosopher who promoted a systematic use of the Pyrrhonic mode of argument. He was acknowledged above all for having set up a double paradox: that any attempt at a rational theodicy must lead to Manicheism and that to argue for a rationalist Christian ethics is to argue the case of an atheistic one as well. It is doubtful whether many of those who do refer to Bayle during this period understood him beyond these terms, whether they sought to understand, or whether they even bothered to read Bayle's lengthy arguments. It is clear that few really grasped his complex, often ambiguous objectives. Mention of a Baylian position by an eighteenth-century writer is therefore no guarantee that the writer has actually read Bayle's works: Bayle is a sort of figurehead for Pyrrhonism, Manicheism, or often even atheism, but one can doubt that there is behind the mention of these basic positions any serious reflection on his thought. There are exceptions of course. Luce and H. M. Bracken have shown that Bayle played a seminal role in the formation of Berkeley's thought? But as a rule, knowledge of Bayle among writers of the Enlightenment was vague; references to him, nonspecific. In most cases it is scarcely possible to speak of an influence. My aim in this...
